INFORMATION FOR BUYERS


I. THE PRINCIPLES OF THE PROCESSING OF PERSONAL DATA


INTRODUCTION


UAB “Nacionalinis bilietų platintojas“, legal entity code 302598528, with its registered address at J. Jasinskio st. 12, Vilnius, LT-01112, Lithuania, address for correspondence Bokšto st. 10-12, Vilnius, LT-01126, Lithuania, (hereinafter  - “Bilietu platintojas“) values the privacy of the clients.

Bilietu platintojas does not collect and shall not store personal data of the clients, all personal data of the clients shall be processed by the company Piletilevi - AS “Piletilevi“, registration code 10568581, address Telliskivi tn 60a / 9, 10412 Tallin, Estonia - from the group of the companies to which the Bilietu platintojas belongs.

The purpose of this document is to explain in a transparent and comprehensible way how and according to which principles the personal data of the clients shall be processed. This document describes the principles of processing of personal data and how personal data shall be processed. Please read the principles of personal data processing carefully to understand how Piletilevi can process your personal data.



1. DEFINITIONS AND ABREVIATIONS


GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation);

Personal data - any information relating to an identified or identifiable natural person (data subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name and surname, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Applicable legislation - all applicable laws of the European Union and the Republic of Lithuania, including, but not limited to, national legislation implementing GDPR.

Client or data subject - a natural person who uses the services of the Bilietu platintojas or expresses a wish to use them and whose personal data is being processed by Piletilevi, including the use of the e-shop of the Bilietu platintojas via the website of the Bilietu platintojas.

Processing of data - any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

Controller of data - the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. For the purposes of these personal data processing principles, the controller of personal data is Piletilevi - AS „Piletilevi“ (registration code 10568581, address Telliskivi tn 60a / 9, 10412 Tallin, Estonia).

Website - the Bilietu platintojas's website http://www.bilietai.lt and all related subdomains or other websites of the Bilietu platintojas and social networks used by the Bilietu platintojas.

Processor of data - a natural or a legal person, public authority, agency or other body which processes personal data on behalf of the controller.

 

2. GENERAL PROVISIONS
 

2.1. The principles of the processing of personal data apply to clients who use the services of the Bilietu platintojas or express their wish to use them. The principles of the processing of personal data shall be also applied to clients who use the e-shop of the Bilietu platintojas.

2.2. Piletilevi hereby guarantees that personal data shall be processed in accordance with applicable laws. The main legal act that Piletilevi shall comply with when processing personal data of the clients is GDPR.

3. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA
 

3.1. Piletilevi processes the personal data of the clients only if it has a legal basis to process them in accordance with applicable law.

3.2. Piletilevi processes personal data of the clients in the following cases:

  1. to conclude a contract, to perform a contract, to guarantee the performance of a contract or to provide services to the clients, for example in order for a client to register as a consumer or in order to use the e-shop of the Bilietu platintojas (legal basis: Article 6 (1) (b) of GDPR;
  2. to fulfil legal obligations, such as the accounting obligations of the Bilietu platintojas (legal basis: Article 6 (1) (c) of GDPR);
  3. in the case of legitimate interest of the Bilietu platintojas or of a third party, unless such interest outweighs the interest of the data subject or the fundamental rights and freedoms requiring the protection of personal data (legal basis: Article 6 (1) (f) GDPR);
  4. Based on the consent of the clients, for example, to receive a newsletter (legal basis: Article 6 (1) (f) GDPR). If the client provides the consent to receive the newsletter, he /she shall have the right to withdraw the consent at any time by clicking on the "Remove" link attached to the newsletter.


4. PROCESSING OF PERSONAL DATA
 

4.1. Piletilevi only processes personal data that is voluntarily provided by the client. Piletilevi does not collect information about the clients from any third parties.

4.2. The exact composition of personal data collected and processed by Piletilevi depends on the specific services that Bilietu platintojas provides to the client in specific circumstances. Detailed conditions for the collection of personal data may be set out in the agreement between Piletilevi and/or Bilietu platintojas and the client.

4.3. In case the client registers as a user of the e-shop of Bilietu platintojas, Bilietu platintojas shall collect the following data of the client required to create an invoice in accordance with the terms and conditions of the e-shop services: name, surname, e-mail address, telephone number of the customer.

4.4. If a transaction (ticket purchase) is performed through the e-shop of Bilietu platintojas (regardless of whether the client is a registered or an unregistered customer of the e-shop), Piletilevi collects the following data about the client:

information about the ticket purchased from the e-shop of Bilietu platintojas (including information about the discount when the ticket is purchased with the discount);

information about the bank account used to perform the transaction (number of the bank account and name and surname of the owner of the account).

 

5. DISCLOSER OF PERSONAL DATA
 

5.1. Piletilevi does not disclose personal data of the clients to third parties without an appropriate legal basis.

5.2. In certain cases, Piletilevi discloses personal data of the clients to the persons entitled (for example, to the organizer of the event to which the client has purchased a ticket), if it is necessary to provide important organizational information, to repurchase the tickets, in case the event has been cancelled or for other important reason.

5.3. Piletilevi has the right to use authorized processors of data for the processing of personal data. In some cases, Piletilevi shall authorize certain persons to process personal data of the clients, for example providers of IT services (server services providers, developers of IT software).

 

6. STORAGE OF PERSONAL DATA
 

6.1. Piletilevi does not store personal data longer than it is necessary for processing of personal data or longer than it is permitted by applicable laws.

6.2. Piletilevi stores the personal data of registered users in Bilietu platintojas’s e-shop until the user decides to delete his account (legal basis: Article 6 (1) (b) GDPR, performance of the contract).

6.3. Piletilevi stores personal data related to contracts concluded between Bilietu platintojas and the client for a maximum of 3 years after the transaction (legal basis: Article 6 (1) (f) GDPR, legitimate interest and limitation period for claims as referred to in paragraph 1).

6.4. Piletilevi shall store accounting documents, which may in some cases include personal data, for 7 years from the end of the financial year in which the financial transaction relating to the document was entered in the accounting book in accordance with the original document (legal basis: Article 6 (1) (c) GDPR).

7. USE OF COOKIES
 

7.1. The website of the Bilietu platintojas uses cookies. These are small text files that contain information stored in the computer of the client to track or to identify the client.

7.3. Clients have the right to disable cookies at any time by changing the settings in their web browser. In this case, the client should evaluate that disabling cookies may prevent some features of the website from working properly. The cookies can be disabled by following the instructions in the "Help" section of the web browser. 8. RIGHTS OF THE CLIENTS
 

8.1. Clients have all the rights arising from the applicable laws regarding the processing of their personal data, in particular the following rights:

  1. the right of access: the clients have the right to ask at any time whether Piletilevi has any of his /her personal data and to receive information about which data is being processed by Piletilevi;
  2. the right to correction: the clients have the right to ask Piletilevi to specify or to correct personal data if the data is insufficient, incomplete or incorrect;
  3. the right to objection: the clients have the right to object the processing of his /her personal data, for example when personal data is used in the legitimate interests of Piletilevi, including profile analysis for the purposes of direct marketing;
  4. the right to erasure: the clients have the right to demand to erase his / her personal data if the processing is based on the consent and the client revokes the consent for processing of personal data;
  5. the right to restriction of processing of data: the clients have the right to demand Piletilevi to restrict the processing of personal data in accordance with applicable law, for example, if Piletilevi no longer needs personal data of the client for the purposes of processing or if the client has objected the processing of his / her personal data;
  6. the right to revoke the consent for processing of personal data: if the client's personal data is processed on the basis of the consent, the client shall have the right to revoke this consent at any time;
  7. the right to transfer: the clients have the right to receive from Piletilevi previously submitted personal data processed with the prior consent or for the purpose of fulfilling the contract concluded with the client, in writing or in a publicly used electronic format and, if technically possible, to request Piletilevi to transfer such data to a third party - the service provider;
  8. right to file a complaint: if the client considers that his or her rights have been violated while processing personal data, he or she shall have the right to file a complaint to the Personal Data Protection Inspectorate or to court.

8.2. The rights of the clients listed in this section related to the processing of their personal data are not absolute rights. In certain cases, the rights of other data subjects or the rights of Piletilevi may limit the rights of the client.

9. SAFETY OF PERSONAL DATA
 

9.1. Piletilevi shall guarantee the security of processing of personal data in order to protect personal data from unintentional or unlawful processing, disclosure or destruction.

9.2. Taking into account the latest research and technological developments, the costs of their application, the nature, scope, context and purposes of the processing of personal data, as well as the different risks to the rights and freedoms of individuals, Piletilevi shall always seek to implement appropriate technical and organizational measures to process personal data to ensure the safety.

  • UAB "Nacionalinis bilietų platintojas" is only an intermediary between ticket buyers and event organizers, therefore is not responsible for events or their quality.
  • Tickets are not exchanged and the money for tickets is not refunded (unless event is canceled or the event date is changed).
  • UAB "Nacionalinis bilietų platintojas" applies ticket service fees.
  • UAB "Nacionalinis bilietų platintojas" shall also be entitled to provide any other additional paid services and collect other fees for the services the provision of which is charged by taxes. Before receiving such services, a person shall be notified about additional charging of the respective service and / or tax applicable for service provision and its amount.
  • When purchasing tickets online at www.bilietai.lt, it is possible to pay by online banking systems and credit cards of SEB, Swedbank, DNB, Nordea and Šiauliai banks.
  • You can purchase a maximum of 10 tickets (unless otherwise specified by the event organizer) with each purchase to a single event.
  • Please inform the seller regarding the application of discounts before you purchase a ticket. When buying tickets online, choose the discount price.
  • In order to receive an invoice, please contact us by email: saskaitos@bilietai.lt.
  • All UAB "Nacionalinis bilietų platintojas" ticket offices accept payments in cash or by credit card ("Rimi" network and shopping center "Ozas" accepts only cash).
  • Heat and intense light can damage a ticket.
  • Regarding ticket refunds, please always contact us at: info@bilietai.lt (unless otherwise specified by the event organizer).

Please be advised that during the refund procedure, the ticket buyer must submit a filled refund application to the company "Nacionalinis bilietų platintojas", application form can be found here.

III. REFUND & EXCHANGE POLICY

Tickets are not exchanged and refunded
- Tickets are not exchanged and refunded, therefore every time before purchasing tickets consider whether you will be able to come to the event and how many tickets you require. BILIETAI.LT also isn't liable if a ticket has been lost or damaged due to you fault and therefore lost its functionality.
 
Ticket refund and exchange in cases of event cancellation or change of the event date:
- BILIETAI.LT is an intermediary between the event organizer (service provider) and the buyer. BILIETAI.LT does not organize events and does not assume responsibility for an event that has failed, its delay, quality or other, event organization related matters. Responsibility for all mentioned matters is assumed by the event organizer.
- In case if the new event date is not suitable or the event was canceled, tickets can be returned until the organizer's indicated date:

  • Tickets can also be refunded at BILIETAI.LT ticket offices (you must submit a filled refund application, which can be found here):

IV. GIFT CERTIFICATE RULES

1. BILIETAI.LT gift certificate or specific organizer's gift certificate (hereinafter - Gift certificate) can be purchased on the website www.bilietai.lt and at the BILIETAI.LT ticket offices, where Gift certificates are distributed.
2. Gift certificate denominations: 10, 15, 20, 30, 40 or 50 EUR.
3. Gift certificate is valid for event tickets, which are distributed on the website www.bilietai.lt or at the BILIETAI.LT ticket offices.
4. Gift certificates can be redeemed online and at the BILIETAI.LT ticket offices (Gift certificates cannot be redeemed in the shopping center "Ozas" and "Rimi" network).
5. BILIETAI.LT Gift certificate gives customer the right to purchase tickets to any events specified at the BILIETAI.LT ticket offices or e-shop www.bilietai.lt for the amount indicated on a gift certificate. Specific organizer's Gift certificate gives the right to purchase tickets only to the events of the specified organizer (or only to the events specified on a Gift certificate).
6. Gift certificate is not nominal.
7. Gift certificate is valid for 12 months from the date of purchase, unless otherwise specified on a gift certificate. Expiration date is indicated on a Gift certificate, the unused value of a Gift certificate is not refunded.
8. If a Gift certificate was not used during its validity period, it is considered invalid.
9. By purchasing a Gift certificate the buyer confirms that he has read and agrees with the Gift certificate purchase and use rules. Distributor reserves the right at any time to change the Gift certificate use rules, which take effect from their publication on the website www.bilietai.lt. Customers are recommended to always get familiar with the latest Gift certificate use rules on the www.bilietai.lt website.
10. Gift certificate cannot be refunded, renewed, changed to a new one (in case of loss) or exchanged for cash.
11. Gift certificate cannot be used to pay for any other gift certificates, which are distributed on the website www.bilietai.lt or at the BILIETAI.LT ticket offices.
12. It is strictly prohibited to falsify copy and reproduce Gift certificates, also use or obtain them in any other unlawful manner. Persons illegally using Gift certificates can be prosecuted under the 182, 300 and other Articles* of the Criminal Code of the Republic of Lithuania. In case of such violations, we always inform the police. Person who uses illegally obtained Gift certificate may lose the right to use ticket purchase services specified on a Gift certificate.

V. DISPUTE SETTLEMENT PROCEDURES

All disputes with BILIETAI.LT are settled by negotiations. If negotiations fail to resolve disputes, they shall be resolved in the courts of the Republic of Lithuania in accordance with applicable laws of the Republic of Lithuania.
Consumer disputes are settled by the State Consumer Rights Protection Authority.

Application/complaint regarding on our website purchased goods or services may be presented to the State Consumer Rights Protection Authority (Vilniaus str. 25, 01402 Vilnius, e-mail tarnyba@vvtat.lt, tel.
